1. Definitions

• “Company,” “we,” “us,” or “our” refers to Pilchuck Property Services LLC, its owners, employees, subcontractors, and affiliates.

• “Client,” “you,” or “your” refers to the individual or entity requesting services from Pilchuck Property Services LLC.

• “Services” means all property maintenance, construction, repair, or related work provided by the Company.

2. Scope of Services

• All work will be performed according to the written estimate, proposal, or signed work order.

• Any additional work requested outside the agreed scope will require a separate written change order and may be billed at an additional rate.

• We reserve the right to refuse or discontinue work if conditions are unsafe, illegal, or violate building codes. We will also keep the 50% deposit given to us.

3. Estimates & Pricing

• Estimates are valid for 30 days unless otherwise stated.

• Actual costs may vary due to unforeseen conditions, material price changes, or scope changes.

• Time and material work is billed at our current hourly rate plus the cost of materials.

• A deposit may be required before work begins.

4. Client Responsibilities

• Provide safe, unobstructed access to the job site.

• Obtain and pay for any necessary permits unless otherwise agreed in writing.

• Notify us in writing of any hazardous materials, hidden utilities, or unsafe site conditions before work begins.

• Maintain insurance coverage on the property during the project.

5. Worksite Conditions & Safety

• We are not responsible for delays caused by weather, labor disputes, supply shortages, or other circumstances beyond our control.

• If unsafe or illegal conditions are found, work will pause until resolved. Additional charges may apply for downtime or remobilization.

6. Materials & Warranties

• Materials remain the property of Pilchuck Property Services LLC until paid in full.

• Manufacturer warranties apply to materials when available; we do not provide any separate warranty unless explicitly stated in writing.

• Workmanship warranty (if offered) covers labor only and excludes damage from misuse, neglect, acts of God, or modifications by others.

7. Limitation of Liability

• We are not liable for:

• Incidental or consequential damages.

• Damage to unmarked underground utilities or hidden structures.

• Pre-existing defects or conditions.

• Losses due to delays outside our control.

• Our total liability is limited to the amount actually paid by you for the specific work in question.

8. Payment Terms

• Payment is due as stated in the invoice or contract.

• Late payments may incur interest of 1.5% per month or the maximum allowed by law, plus collection costs and attorney’s fees.

• Non-payment may result in a mechanic’s lien against the property.

9. Cancellations & Rescheduling

• At least 48 hours’ notice is required to cancel or reschedule work without penalty.

• Cancellations made after the 48-hour notice period will incur a penalty fee equal to 40% of the total bid amount, which will be retained by Pilchuck Property Services LLC.

• In such cases, the original bid will be considered null and void, and any future work will require a new bid and agreement.

• Cancellations after work has begun may also incur charges for labor, materials, and lost scheduling time in addition to the penalty fee, if applicable.

10. Subcontractors

• We may hire qualified subcontractors to perform portions of the work.

• Subcontractors are bound by the same safety and quality standards as our employees.

11. Insurance

• We maintain liability insurance and, where applicable, workers’ compensation coverage.

• Proof of insurance is available upon request.

12. Force Majeure

• We are not liable for delays, damages, or inability to complete work due to events beyond our reasonable control, including but not limited to weather, natural disasters, government actions, supply chain disruptions, or acts of God.

13. Governing Law & Dispute Resolution

• These Terms are governed by the laws of the State of Washington.

• Any disputes shall first be attempted to be resolved through informal negotiation.

• If unresolved, disputes will be handled through binding arbitration in Snohomish County, WA, unless otherwise required by law.

14. Severability

• If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

15. Entire Agreement

• These Terms, along with any signed estimate or contract, represent the entire agreement between the parties and supersede all prior understandings, written or oral.

By requesting or accepting services from Pilchuck Property Services LLC, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
